While we aim to provide you with a highly reliable and readily available service, the Application is not 100 percent reliable or readily available. For a variety of reasons beyond our control, our services may be affected by sporadic interruptions and failures, including WiFi or network instability, cloud service provider maintenance or updates, and hardware device failures. Limitation of liability. Notwithstanding anything to the contrary and to the fullest extent permissible by law: (a) in no event shall we, nor our directors, employees, agents, partners, suppliers or content providers, be liable under contract, tort, strict liability, negligence or any other legal or equitable theory with respect to the services (I) for any lost profits, data loss, cost of procurement of substitute goods or services, or special, indirect, incidental, punitive, compensatory or consequential damages of any kind whatsoever (however arising), (ii) for any bugs, viruses, trojan horses, or the like (regardless of the source of origination), and (b) in no event shall our liability, nor our directors, employees, agents, partners, suppliers or content providers liability under, or otherwise in connection with, these terms (including the site and the service), exceed the greater of the total amount paid by you (if any) in connection with the applicable service in the three (3) months immediately prior to the event giving rise to such liability or (b) $50.00.
